Terms & Conditions for use

Network Name: TT Wi-Fi

 

  1. Agreement

These Terms and Conditions shall govern the relationship between The National Information and Communications Technology Company Limited (hereinafter referred to as “iGovTT”) within which the TT Wi-Fi Network operates; and the Customer for the use of the TT Wi-Fi on Public Transportation Service Corporation (PTSC) Buses and related services and features, brought to the Customer by iGovTT and delivered using Digicel Business’ Technology (“the Service”).  These Terms and Conditions are governed by the Laws of the Republic of Trinidad and Tobago.

  1. Service Description

The Service provides the Customer with free wireless access to the internet via certain access points located only on the PTSC buses installed with the TT Wi-Fi Service. The Customer can connect to the Service using any Wi-Fi capable device, including devices without SIM cards and non Digicel devices.

  1. Registration

I) CUSTOMERS WILL BE AFFORDED ONE (1) HOUR ACCESS PER SESSION OF CONNECTIVITY (ACCESS PERIOD);

II) Customers who wish to use the Service will be required to accept the outlined Terms and Conditions listed herein, in order to start an Access Period;

III)  By clicking “Agree” on said page all Customers will be deemed to have accepted the Terms and Conditions as worded herein.

  1. Availability of Service

iGovTT does not guarantee the availability of the Service. The availability of the Service is subject to certain equipment and compatibility/limitations including memory, storage, Digicel’s network availability, coverage, accessibility and data conversion limitations.

The accuracy, appropriateness, content, completeness, timeliness, usefulness, security, safety, transmission or correct sequencing of any information or downloaded data is not guaranteed by iGovTT. If the Customer uses his/her mobile handset or wireless device to access his/her official company e-mail or information, it is the Customer’s responsibility to ensure that the use complies with his/her company's internal IT and security procedures.

All download speeds experienced depend on device characteristics, Digicel’s network availability and coverage levels, tasks, file characteristics and other factors. Performance may be impacted by transmission limitations, terrain, in-building/in-vehicle use and other capacity constraints.

  1. Fair usage

iGovTT reserves the right to terminate the Service forthwith if in its sole opinion the Service is being abused by the Customer, such abuse to include but not be limited to the following:-

A)  commercial use of the Service;

B)  peer to peer file sharing;

C) restricting or inhibiting any other users from using the Service;

D) any use that infringes upon others’ intellectual property rights;

E) posting, publishing, reproducing, distributing or transmitting any unlawful, threatening, abusive, libellous, defamatory, vulgar, obscene, indecent, pornographic, profane, hateful, bigoted or otherwise objectionable information of any kind, including without limitation any transmissions, constituting, or encouraging conduct that would constitute, a criminal offence, give rise to civil liability;

F) posting or transmitting any information or software that contains a trojan, worm, virus or other harmful component;

G) avoiding, bypassing, removing, deactivating or circumventing by any means, any process or system such as copy protection systems that are intended to protect the rights of a copyright owner; 

H) sending large quantities of unwanted or unsolicited e-mail to individual e-mail accounts (also known as ‘spamming’ or ‘mail bombing');

I) making any unauthorized attempt to gain access to any account or computer resource not belonging to that of the Customer (also known as 'spoofing', ‘phishing’);

J) making any unauthorized access, alteration, destruction, or any attempt, of any information of any PTSC passengers or other users connected to the Service by any means or device;

K)  running programs or servers that provide network services to others through the Service ("web hosting"), which includes, but is not limited to, operating a web/mail/ftp server to serve external connections;

L) reselling or providing access to the Service to any third party, without the prior express written consent of iGovTT. Breach of this provision may result in immediate suspension of the Service until the problem is corrected;

M) any use deemed by iGovTT to interfere with the its ability to fairly allocate capacity among other Customers or that otherwise degrades service quality on the network.

iGovTT further reserves the right to take measures to protect Digicel’s network and its Customers from harm, compromised capacity or degradation in performance. These measures may impact the Customer’s service, and iGovTT reserves the right to deny, modify or terminate the service, with or without notice, to any Customer that is believed to be using the Service or features thereof in a manner that adversely impacts on the Digicel network or contrary to the said Terms and Conditions.

iGovTT may monitor the Customer’s compliance with these Terms and Conditions but will not monitor the content of communications except as otherwise expressly permitted or required by Law.

  1. Customer Obligations

In addition to the obligations under this Agreement, Customers:

A) agree to abide by all these Terms and Conditions of use of the Service as outlined herein;

B) agree to comply with Laws and regulations governing the Digicel network;

C) agree to utilize the Service for personal use only and not for commercial and/or business purposes;

D) agree to comply with all reasonable requests by iGovTT, or others on behalf of iGovTT, particularly in relation to the investigation of fraud or other offences or as required by law or in legal proceedings. Should iGovTT deem it necessary to enforce its rights hereunder in any legal action, the Customer agrees to cooperate with iGovTT in any such action.

E) accept that the Service, which utilizes wireless technologies, is not inherently secure and that wireless communications can be intercepted by technology designed and intended for that purpose. iGovTT will not be liable to the Customer or any other party for any lack of security that may result from the Customer use of the Service. The Customer agrees that he/she is responsible for providing security measures that are suited for the Customer’s intended use of the Service. For example, the Customer shall take full responsibility for taking adequate measures for safeguarding their data from loss; and

F) accept that they must provide all equipment, technology and software to use the Service.

  1. Privacy Policy

iGovTT, as the provider of the service does not seek to capture or store any personal information from the Customer of the system. iGovTT is providing wireless connectivity as a public service and offers no guarantees or representations that any use of the wireless connection is in any way secure, or that any privacy can be protected when using this wireless connection. Use of this wireless connection is entirely at the risk of the Customer, and iGovTT is not responsible for any loss of any information that may arise from the use of the wireless connection, nor is iGovTT responsible for any loss, injury, or damages resulting from the use of the wireless connection. Customers using the wireless network provided by iGovTT, is accepting that there can be no expectation of privacy when using the wireless network.

The following data will be captured and stored for the exclusive use of the Digicel Technical team and iGovTT’s Technical team ONLY, for the sole purpose of the technical operation of the Service, subsequent to which it shall be automatically purged after a few days:-

  1. A Media Access Control Address (MAC address) which is a unique identifier assigned to network interfaces for communications on the physical network segment;

  2. The Device Hostname which is the label that is assigned to the Customer’s device connected to the TT Wi-Fi Network that is used to identify the Customer’s device in various forms of electronic communication; and

  3. Traffic Data per session will be logged. Traffic Data is defined as any data processed for the purpose of the conveyance of a communication on the TT Wi-Fi Network and includes data relating to the routing, duration or time of a communication

This information shall be kept confidential and shall not be disclosed to any third party save and except if required to do so by law, or through the express permission of the Customer.

The Customer understands and agrees that, upon registration to use the Service, iGovTT retains the right to access, and disclose said data only if required to do so by law or in a good faith belief that such disclosure is necessary to comply with legal or security processes, or to protect the rights and property of iGovTT or the public.
